Privacy Policy
Scope of This Policy
This policy applies to implementations of EmpowerU’s services where all student data is collected, entered, and managed by authorized school personnel. EmpowerU does not collect student data directly from students or parents.
Role of EmpowerU
EmpowerU acts solely as a service provider under the California Consumer Privacy Act (CCPA) and as a school official under the Family Educational Rights and Privacy Act (FERPA). We process student data only on behalf of our school partners and solely for the purpose of delivering contracted educational and support services.
EmpowerU is not the data controller and does not determine the purposes or means of processing student data. The school maintains full control over student information and is responsible for meeting parental consent obligations under applicable laws, including COPPA, FERPA, and state student privacy laws.
Collection and Use of Student Data
All student data is provided by school partners. The types of student data that may be entered or shared with EmpowerU (at the discretion of the school) include:
- Student ID numbers or unique identifiers
- Class, grade level, or program participation
- Engagement metrics or progress data
EmpowerU does not:
- Collect personal information directly from students under the age of 13 without school authorization,
- Use student data for behavioral advertising, profiling, or commercial purposes,
- Sell or share student data with third parties for non-educational purposes.
Data is used solely to deliver EmpowerU’s services, track program effectiveness, and support student growth in accordance with school directives.
Data Control and Parental Rights
In this model, the school is the data controller. Schools are responsible for obtaining any required parental consents under COPPA and FERPA.
Parents or legal guardians who wish to:
- Review their child’s personal information,
- Request deletion or correction of that information, or
- Restrict further use or sharing of their child’s data,
should contact their school directly. EmpowerU is not authorized to respond to such requests independently but will fully cooperate with the school partner in fulfilling them.
Security Measures
EmpowerU uses reasonable and appropriate administrative, technical, and physical safeguards to protect student information from unauthorized access, disclosure, or misuse. Access to student data is limited to personnel who require it to provide services and are bound by confidentiality obligations.
Data Retention
EmpowerU retains student data only as directed by our school partners and only for as long as necessary to fulfill the educational services for which the data was provided. Upon request from a school or upon termination of the agreement, EmpowerU will securely delete or return student data in accordance with record retention policies and legal obligations.
